Why this matters
On 16 May 2025, Ofgem issued its decision to reject Change Proposal R0137—Introducing Third Party Intermediary (Energy Broker) Assurance and Accreditation. While this means that adherence to the existing voluntary Third-Party Intermediary Code of Practice (TPI CoP) will not become mandatory, Ofgem expressed support for the continued voluntary operation and development of the CoP.
With this in mind, we’ve reviewed the CoP in light of recent industry developments and regulatory changes and propose a number of updates to its text.
We’re also seeking your views on potential future enhancements to the CoP, including:
- Introducing a formal logo or ‘kitemark’ that signatories can display
- Accrediting signatories
- Extending the TPI register to include signatories of other (non-REC) voluntary CoPs
What’s changing in the TPI Code of Practice?
The proposed changes to the TPI CoP include:
- Making updates to recognise that Alternative Dispute Resolution (ADR) schemes must be available to both Small and Micro Business customers
- Clarifying that ADR schemes signposted by TPIs could be one of multiple scheme providers
- Recognising that annual consumption data introduced by Market-wide Half Hourly Settlement (MHHS) can be used as accurate consumption data for electricity Metering Points migrated into MHHS
- Updating Principle 1, Transparency and Accuracy, to clarify the level of detail that should be provided to consumers on TPI enumeration
- Updating the Letter of Authority template, including the removal of the use case allowing TPIs to sign and enter contracts on behalf of consumers
- Making minor terminology corrections
How can I help shape the future of the voluntary code?
Importantly, we’re inviting feedback from impacted stakeholders on the following questions:
- Would you support RECCo exploring options to provide a ‘kitemark’ for TPI CoP signatories, with accreditation against the TPI CoP?
- Would you support extending the TPI Register to include TPIs signed up to other non-REC voluntary TPI Codes of Practice?
Responses to these questions will help inform the next steps in developing the voluntary TPI CoP.
